규정 소개(Introduction)

 

SEC 사실확인(Factual Review) 운영규정은 ESG 평가의 정확성, 객관성 및 신뢰성을 확보하기 위하여 평가결과 확정 전 사실확인 절차의 운영기준을 규정하기 위하여 제정되었다.

 

The SEC Factual Review Regulations have been established to define the operational standards governing the Factual Review process prior to the finalization of ESG evaluation results in order to ensure accuracy, objectivity, and credibility.

SEC는 평가결과의 신뢰성 확보를 위하여 공개자료를 기반으로 평가를 수행하고 있으며, 평가대상 기관 및 기업이 평가에 활용된 사실관계에 대하여 의견을 제출할 수 있는 기회를 제공하고 있다.

 

SEC conducts evaluations primarily based on publicly available information and provides evaluated institutions and corporations with an opportunity to submit comments regarding factual matters used in the evaluation process.

사실확인(Factual Review)은 평가과정에서 활용된 자료의 정확성, 누락 여부 및 객관적 사실관계를 검토하기 위한 절차이며, 평가기준이나 평가방법론을 변경하기 위한 절차가 아니다.

 

The Factual Review process is intended to verify the accuracy, completeness, and factual basis of information used in evaluations. It is not a process for altering evaluation criteria or methodologies.

SEC는 사실확인 절차를 통하여 평가의 정확성과 공정성을 높이고, 평가대상 기관 및 기업의 권리를 보호하며, 평가결과에 대한 이해관계자의 신뢰를 강화하고자 한다.

 

Through the Factual Review process, SEC seeks to enhance the accuracy and fairness of evaluations, protect the rights of evaluated institutions and corporations, and strengthen stakeholder confidence in evaluation results.

 

제1장 총칙

Chapter 1 General Provisions

 

제1조(목적)

Article 1 (Purpose)

 

본 규정은 SEC(Sustainable Enterprise Evaluation Commission)가 실시하는 ESG 평가의 사실확인(Factual Review) 절차에 관한 사항을 규정함으로써 평가결과의 정확성, 객관성 및 신뢰성을 확보하는 것을 목적으로 한다.

 

The purpose of these Regulations is to establish procedures governing the Factual Review process for ESG evaluations conducted by the Sustainable Enterprise Evaluation Commission (SEC), thereby ensuring the accuracy, objectivity, and credibility of evaluation results.

 

제2조(적용범위)

Article 2 (Scope of Application)

본 규정은 SEC가 실시하는 ESG 평가와 관련된 사실확인 절차에 적용한다.

These Regulations shall apply to Factual Review procedures relating to ESG evaluations conducted by SEC.

 

제3조(정의)

Article 3 (Definitions)

본 규정에서 사용하는 용어의 뜻은 다음과 같다.

The terms used in these Regulations shall have the following meanings:

“사실확인(Factual Review)”이란 평가결과 확정 전에 평가에 활용된 자료 및 사실관계의 정확성을 검토하는 절차를 말한다.

“Factual Review” means the process of verifying the accuracy of information and factual matters used in an evaluation prior to the finalization of evaluation results.

“평가대상”이란 SEC의 평가를 받는 공공기관 또는 기업을 말한다.

“Evaluation Subject” means a public institution or corporation subject to evaluation by SEC.

“평가자료”란 평가에 활용된 공개자료, 공시자료, 보고서 및 기타 관련 자료를 말한다.

“Evaluation Data” means public information, disclosure materials, reports, and other relevant information used in the evaluation process.

 

 

제2장 사실확인 절차

Chapter 2 Factual Review Procedures

 

제4조(사실확인의 실시)

Article 4 (Conduct of Factual Review)

① SEC는 평가등급 확정 전에 사실확인 절차를 운영할 수 있다.

SEC may conduct a Factual Review process prior to the final determination of ESG Ratings.

② SEC는 필요하다고 인정하는 경우 평가대상에게 사실확인 기회를 제공할 수 있다.

SEC may provide evaluation subjects with an opportunity to participate in the Factual Review process where deemed necessary.

 

제5조(자료 제출)

Article 5 (Submission of Information)

① 평가대상은 사실확인 기간 중 사실오류, 자료누락 또는 객관적으로 입증 가능한 사항에 대한 의견을 제출할 수 있다.

Evaluation subjects may submit comments regarding factual errors, omissions, or objectively verifiable matters during the Factual Review period.

② 제출자료는 객관적으로 확인 가능한 근거자료를 포함하여야 한다.

Submitted information shall be accompanied by objectively verifiable supporting evidence.

 

제6조(검토 절차)

Article 6 (Review Procedures)

① SEC는 제출된 자료와 의견을 검토하여 사실관계를 확인한다.

SEC shall review submitted information and comments to verify relevant facts.

② SEC는 필요하다고 인정하는 경우 추가 자료의 제출을 요청할 수 있다.

SEC may request additional information where deemed necessary.

 

제7조(검토 결과)

Article 7 (Review Results)

① SEC는 사실확인 결과 평가자료의 오류 또는 누락이 확인된 경우 이를 수정할 수 있다.

SEC may revise evaluation information where factual errors or omissions are confirmed through the Factual Review process.

② SEC는 검토 결과를 최종 평가에 반영할 수 있다.

SEC may reflect the review results in the final evaluation.

제3장 사실확인의 범위

Chapter 3 Scope of Factual Review

 

제8조(사실확인 대상)

Article 8 (Matters Subject to Factual Review)

사실확인의 대상은 다음 각 호의 사항으로 한다.

The following matters shall be subject to Factual Review:

사실관계의 오류

Factual errors

자료의 누락

Omissions of information

수치 및 통계자료의 오류

Errors in numerical or statistical information

객관적으로 입증 가능한 사항

Objectively verifiable matters

 

제9조(사실확인의 제한)

Article 9 (Limitations of Factual Review)

① 사실확인 절차는 평가기준의 변경을 목적으로 하지 아니한다.

The Factual Review process shall not be intended to alter evaluation criteria.

② 사실확인 절차는 평가방법론의 변경을 목적으로 하지 아니한다.

The Factual Review process shall not be intended to alter evaluation methodologies.

③ 사실확인 절차는 정책적 판단 또는 평가위원회의 전문적 판단을 변경하기 위한 절차가 아니다.

The Factual Review process shall not be used to alter policy judgments or professional judgments made by the Evaluation Committee.

④ 평가결과에 대한 단순한 이견은 사실확인의 대상이 되지 아니한다.

Simple disagreement with evaluation results shall not constitute grounds for a Factual Review.

 

제4장 비밀유지 및 정보보호

Chapter 4 Confidentiality and Information Protection

 

제10조(비밀유지)

Article 10 (Confidentiality)

SEC와 평가 관련자는 사실확인 절차를 통하여 취득한 비공개 정보를 보호하여야 한다.

SEC and all persons involved in the evaluation process shall protect non-public information obtained through the Factual Review process.

제11조(정보의 활용 제한)

Article 11 (Restrictions on Information Use)

사실확인 과정에서 제출된 자료는 평가 목적 외의 용도로 사용하여서는 아니 된다.

Information submitted during the Factual Review process shall not be used for purposes other than evaluation.

 

 

제5장 보칙

Chapter 5 Supplementary Provisions

 

제12조(세부사항)

Article 12 (Detailed Matters)

본 규정의 시행에 필요한 세부사항은 SEC가 별도로 정하는 기준에 따른다.

Detailed matters necessary for the implementation of these Regulations shall be governed by standards established separately by SEC.

부칙

Supplementary Provisions

제1조(시행일)

Article 1 (Effective Date)

본 규정은 2026년 1월 1일부터 시행한다.

 

These Regulations shall take effect on January 1, 2026.

제2조(적용례)

Article 2 (Application)

본 규정은 「제1회 WFPL 공공기관·기업 ESG 평가」에 적용한다.

 

These Regulations shall apply to the 1st WFPL ESG Evaluation for Public Institutions and Corporations.
